What is Mediation?

Mediation is an alternative to resolving disputes. Mediation is like a settlement conference where parties meet to attempt to resolve disputes that if left unaddressed may end up litigated. What sets mediation apart from a settlement conference is that it is conducted by a mediator. This is an unbiased individual who has been certified to conduct mediations. The mediator is trained to assist the parties reach an agreement. If there is an agreement, it is reduced to writing and signed by all parties, their attorneys, and the mediator. Once this agreement is filed with the court, the issue is essentially resolved. It is very hard for someone to vacate the mediated settlement agreement.
