What is Mediation?
Mediation is an alternative to resolving disputes. Mediation is like a settlement conference where parties meet to attempt to resolve disputes that if left unaddressed may end up litigated. What sets mediation apart from a settlement conference is that it is conducted by a mediator. This is an unbiased individual who has been certified to conduct mediations. The mediator is trained to assist the parties reach an agreement. If there is an agreement, it is reduced to writing and signed by all parties, their attorneys, and the mediator. Once this agreement is filed with the court, the issue is essentially resolved. It is very hard for someone to vacate the mediated settlement agreement.
Why is Mediation a Good Option for You?
First, mediation is the only opportunity you will have to resolve the issue and have control over what is incorporated within your order. If the parties resolve the issue, they have each negotiated the terms. Often times, a mediated settlement agreement addresses specific custom provisions that would not otherwise be there if the parties end up having a contested hearing. The reason for this is that the Courts have to apply the law and more often than not, the order rendered by the Judge is not case specific and lacks custom provisions that are not provided for in the Texas Statutes. Mediated settlement agreements are a good way to have a custom order designed with your specific concerns in mind.
Second, mediation is often times much less expensive than having a contested hearing before a judge. After paying attorney’s fees and court costs, expert witness fees, jury fees, court reporter fees and other related costs a party can incur several thousand dollars litigating the case. However, if the parties are able to resolve their case through mediation, the attorney’s fees and costs are reduced significantly.
